• 1. Introduction

  Briner Tax Advisory values your privacy. This Data Protection & Privacy Policy demonstrates our commitment to protecting your privacy and the confidentiality of your personal data (“Personal Data”) when you engage us for professional services (“Services”), use our website, or communicate with us.

  By engaging us for Services and/or communicating with us through the contact form on our website, by email, or through other channels, and/or accessing our website or other content we provide, you agree to this Data Protection & Privacy Policy. If you do not agree with any part of this Policy, you must inform us and discontinue use of our Services and/or website or other content. In this case, we will not be able to provide you with further Services.

  For the purposes of applicable data protection laws, we act as the data controller.

  We process personal data that you provide to us when using our Services or communicating with us. This includes, but is not limited to, your name, email address, postal address, phone number, language preference, professional title, business affiliations, professional field of activity, and the content of communications.

We do not subject you to high-risk profiling or automated individual decision-making.

  We generally retain personal data for as long as necessary for our processing purposes, statutory retention periods, or our legitimate interests, particularly for documentation and evidentiary purposes or where retention is technically required (e.g., as part of backups). Where these grounds for retention do not apply, we delete personal data as part of our regular procedures.

  Briner Tax Advisory AG does not use cookies, particularly no tracking, marketing, or profiling cookies. Our website only uses technically necessary elements required for the operation of the site.

  For anonymized analysis of website usage, we use Plausible Analytics, a privacy-friendly statistics platform without cookies. This exclusively collects aggregated usage data (e.g., session duration, device and browser type, entry and exit pages). The analysis is conducted without personal reference, without creating user profiles, and without sharing data with third parties.

  Please note that independent third-party providers (e.g., Google, Meta, or other platforms) whose content or services you already use may independently process your activities on the internet. If you are logged in there or use their services, these providers may potentially associate your usage behavior across different websites. In this case, the processing is exclusively governed by the privacy policies of the respective third-party providers.

• 6. Our Legal Basis for Processing Your Personal Data

  The processing of personal data for the purposes described herein is based – to the extent and insofar as required – on one or more of the following legal grounds: (a) your consent to this Data Protection & Privacy Policy, (b) our legitimate interests in communicating with you as a business contact about our activities, our events, and/or the provision of Services, (c) the performance of a contract, or (d) another basis for the lawful processing of personal data under applicable laws and regulations.

• 7. Protection of Your Personal Data

  Personal data is processed only by us and our technology providers, who are obligated to protect personal data to the same extent as we do. We restrict the use of and access to personal data to those individuals who strictly need it to enable us to provide you with our Services, access to our website, and/or communication with you. When we process personal data as part of an engagement, we process such personal data according to your instructions. In some cases and depending on the nature of our Services and the instructions received, personal data may be disclosed to third parties, such as external law firms, experts, (contractual) counterparties, authorities, and courts in Switzerland and abroad, including in countries where an adequate level of data protection is not guaranteed, insofar as such data exchange is legally required or you request it.

  Briner Tax Advisory processes personal data either itself or with service providers based in Switzerland, the EU, the EEA, or EFTA. Sensitive information and documents are stored exclusively in Switzerland. Only video conferences and appointment data are processed on servers in Norway and Germany. No personal data is transmitted to providers outside these regions. Services such as Google Business Profile or Google advertising services are used exclusively to the extent necessary for the visibility of Briner Tax Advisory AG. No personal data is transmitted via cookies, pixels, or similar tracking technologies.

  We do not sell or transmit personal data to third parties, except with your prior consent or when we are legally or regulatorily obligated to do so. We maintain appropriate technical and organizational measures to preserve the confidentiality, availability, and integrity of personal data. We regularly review our security policies and procedures to ensure that our systems are secure and protected, and ensure compliance with all applicable data protection and security laws.

  We grant you all rights to which you are entitled under applicable data protection law. Should you be affected by inaccurate or incomplete personal data, you may request the correction or completion of the relevant data. To the extent permitted by applicable law, you may request the deletion of your personal data or a temporary restriction of processing in certain cases, and you may also object to the processing of your personal data. In these cases, however, we may not be able to provide associated Services.
